for Influencer Subscribers

 

1. Introduction

These Terms and Conditions (“Agreement”) govern the use of the BestFanChat platform (“Service”) by influencers (“Influencer Subscriber,” “you,” or “your”). By subscribing to and using BestFanChat, you agree to comply with these terms.

BestFanChat is an AI-powered platform designed to enhance influencer-fan engagement by creating and managing personalized, automated conversations on behalf of influencers. This Agreement establishes the rights, responsibilities, and limitations associated with using BestFanChat.

 

2. Purpose of the Service

BestFanChat enables influencers to:

  • Engage with an unlimited number of fans and followers 24/7 without manual intervention.
  • Create AI-driven chats that replicate their unique style, emojis, and tone.
  • Maintain AI-powered memory of fan details, including birthdays, interests, family, friends, pets, and other contextual information.

Your BestFanChat profile will be based on your input, past interactions, and artificial intelligence learning to provide a personalized and seamless fan engagement experience.

 

3. Disclaimer & Limitation of Liability

  • BestFanChat provides AI-powered interactions aligned with your input and preferences but does not guarantee complete accuracy, appropriateness, or legality of the content generated.
  • BestFanChat is not responsible for any chats, recommendations, or messages generated by the AI, nor for any consequences resulting from these interactions.
  • The Influencer Subscriber assumes full responsibility for all content, messages, affiliate promotions, push notifications, and other communications conducted via their AI profile.
  • BestFanChat does not provide legal, financial, or professional advice. Any recommendations made through the AI chat should be independently verified by the subscriber.

 

4. Content Responsibility

As an Influencer Subscriber, you acknowledge and accept that:

  • You are solely responsible for any monetization activities, including affiliate links, promotions, and email marketing campaigns executed via BestFanChat.
  • You will not use BestFanChat for unlawful, misleading, defamatory, abusive, or inappropriate communications.

 

5. Data Ownership & Privacy

  • The Influencer Subscriber retains full ownership of all fan and follower data collected through their BestFanChat profile.
  • By using the Service, fans and followers automatically consent to the collection, storage, and processing of their data for personalized AI-driven engagement.
  • BestFanChat may perform macro data analysis for internal improvements and cost-efficiency but will not utilize or sell individual fan data for marketing or third-party purposes.
  • BestFanChat will ensure compliance with GDPR, CCPA, and other applicable data protection laws regarding the handling of fan and follower data.

 

6. Subscription & Pricing

  • The subscription includes:
    • Monthly profile setup adjustment
    • 1 in-app sequence setup
    • 1 push notification setup
    • 1 affiliate link or promotion setup
    • 1 analytics batch
    • 1 email export
  • Services cannot be carried over from one month to another
  • Additional services beyond the subscription package require separate purchases and may involve manual labour.
  • BestFanChat reserves the right to adjust pricing due to inflation, operational costs, or extraordinary expenses unless otherwise explicitly stated in an offer.
  • A 30-day money-back guarantee is provided, allowing subscribers to cancel and receive a full refund within the first 30 days—no questions asked.

 

7. Termination & Account Suspension

BestFanChat reserves the right to suspend or terminate an account if:

  • The Influencer Subscriber violates these Terms and Conditions.
  • Unauthorized use of the Service is detected, including fraud, abuse, or non-compliance with advertising laws.
  • The Subscriber engages in behaviour that negatively impacts BestFanChat’s reputation or operations.

Subscribers may cancel their subscriptions at any time. No refunds will be issued after the 30-day money-back period unless explicitly agreed upon.

 

8. Intellectual Property Rights

  • All AI-generated chat content is owned by the Influencer Subscriber, subject to compliance with these Terms.
  • BestFanChat retains ownership of the platform, software, AI models, and proprietary algorithms.
  • Subscribers may not copy, reverse-engineer, resell, or distribute BestFanChat’s technology or intellectual property.

 

9. Amendments & Modifications

BestFanChat reserves the right to update these Terms and Conditions at any time. Changes will be communicated via email or in-app notifications. Continued use of the Service after an update constitutes acceptance of the revised terms.

 

10. Governing Law & Dispute Resolution

This Agreement shall be governed by and interpreted in accordance with the laws of Denmark. Any disputes arising from this Agreement shall be resolved through negotiation, mediation, or binding arbitration in Denmark, unless otherwise required by law.
